Listing Service Agreement
The standard terms for Businesses, Professionals, Schools, Education providers, NGOs, NPOs, Churches and Community organisations listed on Find At Home.
This Agreement applies to paid Find At Home Listing Plans and should be read with the selected plan, applicable invoice or written quotation.
A Find At Home Listing gives the Client a professional profile and another way for local customers to discover and contact the Client. It does not guarantee enquiries, sales or a particular search position. Listing Plans are annual services and the Client is responsible for keeping submitted information accurate and lawful.
1. Agreement and Appointment
1.1 The Client appoints Find At Home Network (Pty) Ltd (“Find At Home”, “FAH”, “we”, “us”) to create, publish and manage the Client’s Listing on the Find At Home platform according to the selected plan, this Agreement and any accepted invoice or written quotation.
1.2 The person accepting this Agreement confirms that they are authorised to act for the listed business, institution or professional.
1.3 Acceptance may be recorded by signature, electronic acceptance, payment of the applicable Listing invoice after receiving these terms, or another clear recorded method of acceptance.
2. Listing Plans and Annual Fees
2.1 Current standard annual Listing prices depend on the Listing category. Businesses and Professionals: Starter – R950 per year; Enhanced – R2,500 per year; Premium – R4,995 per year. Schools and Education: Presence – R750 per year; Enhanced – R1,500 per year; Premium / Featured – R2,995 per year. NGOs, NPOs, Churches and Community organisations: Presence – R500 per year; Enhanced – R1,250 per year; Premium / Featured – R2,500 per year. A different written quotation, promotion or approved arrangement may apply where expressly agreed.
2.2 The three plan levels follow the same general value path across Listing categories: Get Found, Build Trust and Get More Exposure. Starter / Presence currently provides the core professional profile with one image and is not Featured. Enhanced currently allows a fuller presentation with up to three images. Premium / Featured currently allows up to six images, an optional video where supported, and eligibility for rotating Featured exposure.
2.3 The lower pricing available to Schools and Education providers, and to NGOs, NPOs, Churches and Community organisations, reflects FAH’s approved pricing structure for those categories. Plan features may differ by Listing type where the platform’s data structure or product design requires it. The applicable Pricing page, quotation or written confirmation should be read with this Agreement.
2.4 Listing fees are normally payable annually. The Listing period begins on the recorded start date or publication date stated by FAH and continues for the applicable annual term.
3. What the Listing Service Provides
3.1 FAH provides a directory profile designed to help customers understand what the Client offers, where the Client operates and how to contact the Client.
3.2 Depending on the Listing type and information supplied, the public profile may display a cover image, description, services, category, primary area, contact details, WhatsApp, telephone, email, website, Google profile, operating hours, map/location, gallery, video, verification badge or Featured status.
3.3 FAH prioritises direct customer contact. A Listing is not an e-commerce service and FAH does not normally collect or hold money for transactions between directory visitors and independent Listing owners.
4. Client Information, Content and Permissions
4.1 The Client must provide accurate, current and complete information and must promptly tell FAH when important details change.
4.2 The Client warrants that it owns, has permission to use, or is otherwise legally entitled to provide all names, logos, photographs, videos, descriptions, qualifications, registration details and other material supplied to FAH.
4.3 The Client remains responsible for the truth and legality of claims about its services, qualifications, prices, licences, products, experience and business status.
4.4 The Client grants FAH a non-exclusive licence for the Listing term to resize, format, edit for clarity and display supplied content as reasonably necessary to operate and promote the Listing and Find At Home platform.
4.5 FAH may refuse or remove content that is unlawful, misleading, unsafe, infringing, discriminatory, fraudulent, materially inaccurate or inconsistent with platform requirements.
5. Categories, Areas and Search Presentation
5.1 A Listing uses one main category and one primary searchable area under the current platform structure. Service-area wording may be included where appropriate but does not replace the primary searchable area.
5.2 FAH may make reasonable formatting, taxonomy or display adjustments so that Listings work consistently within the directory.
5.3 FAH does not sell a permanent number-one search position. Premium or other eligible Featured Listings may receive rotating or fair Featured exposure according to platform rules, dates, eligibility and available placement.
5.4 Search order, Featured rotation and platform design may change as FAH improves the service, provided that FAH does not intentionally misrepresent the Client’s purchased plan.
6. Verification and Badges
6.1 Verification is a separate trust signal and is not a guarantee of workmanship, prices, safety, licensing, financial standing or future conduct.
6.2 Business Verified currently requires accepted official CIPC registration documentation that allows FAH to check submitted business details. Identity Verified is a separate verification level for an applicable individual or authorised representative.
6.3 FAH may request additional information where reasonably necessary to confirm authority or accuracy.
6.4 FAH may review, suspend or remove a verification badge if information changes, cannot be confirmed, becomes outdated or no longer meets the applicable verification requirements.
7. Publication Time and Client Delays
7.1 A completed Listing is normally prepared for publication within approximately three working days after FAH has received payment and all required information, documents and suitable images.
7.2 This is a service target rather than an absolute guarantee. Missing information, unclear documents, unsuitable images, verification questions, technical issues or Client delays may extend the publication time.
8. No Guarantee of Customers or Sales
8.1 A Listing creates an additional opportunity for discovery and direct contact. FAH does not guarantee a particular number of views, enquiries, customers, bookings, contracts, revenue or sales.
8.2 Results can be affected by demand, location, competition, pricing, seasonality, the Client’s offer, profile quality, responsiveness and factors outside FAH’s control.
8.3 FAH does not guarantee a particular Google ranking or other third-party search-engine position.
9. Customer Transactions and Disputes
9.1 The Client is an independent provider and is responsible for its own quotations, prices, contracts, service delivery, warranties, licences, taxes, customer communications and payment arrangements.
9.2 Unless expressly agreed otherwise for a separate FAH service, FAH is not a party to contracts or transactions between the Client and directory visitors.
9.3 FAH may review complaints for platform-rule purposes, but FAH does not replace a court, regulator, ombud, consumer forum or other lawful dispute-resolution process.
10. Updates and Listing Management
10.1 The Client may request reasonable corrections or updates to keep Listing information accurate.
10.2 Major content preparation, repeated redesign-type requests, new media production or work outside normal Listing management may be quoted separately where additional work is required.
10.3 FAH may correct obvious formatting issues, broken links, unsafe display problems or technical errors without changing the substance of the Client’s business information.
11. Suspension or Removal
11.1 FAH may suspend, hide, correct or remove a Listing where reasonably necessary because of non-payment, expiry, unlawful or prohibited content, impersonation, material misrepresentation, security risk, repeated platform abuse, inability to verify authority, or a serious breach of this Agreement.
11.2 Where appropriate, FAH will give the Client notice and a reasonable opportunity to correct a remediable problem before permanent removal.
11.3 FAH may act more quickly where continued publication creates a legal, security, fraud or public-safety risk.
12. Renewal, Expiry and Cancellation
12.1 Listing Plans are annual services. Renewal is subject to the price and plan terms offered for the next period.
12.2 FAH will not treat this Agreement as permission to charge an unapproved payment method automatically. Renewal must follow the applicable invoice, accepted renewal arrangement or other lawful payment process.
12.3 If the Listing is not renewed, it may be marked expired or inactive and removed from normal public search results or Featured placement after the paid term ends.
12.4 A Client may request cancellation or removal in writing. Any refund or financial consequence depends on the circumstances, service already supplied, the applicable agreement and any rights that cannot lawfully be excluded under South African law.
12.5 Removal of a Listing does not automatically create a right to a full refund for an annual service period that has already commenced or been substantially performed, subject always to applicable law.
13. Unclaimed Listings, Management and Corrections
13.1 FAH may publish a basic unclaimed directory profile using publicly available business information for local discovery purposes.
13.2 An authorised owner or representative may request to manage, correct, update or remove an unclaimed profile. FAH may require reasonable evidence of authority before changing ownership-sensitive information.
13.3 Managing, correcting or updating an unclaimed profile does not by itself create a paid Listing Plan unless the Client separately purchases or accepts the applicable paid service.
14. Privacy and Personal Information
14.1 Each party must handle personal information in accordance with applicable South African data-protection law, including POPIA where applicable.
14.2 The Client authorises FAH to publish the business contact information and other Listing information that the Client submits or approves for public display.
14.3 The Client must not provide personal information about third parties unless it has a lawful basis and appropriate authority to do so.
15. Intellectual Property and Platform Rights
15.1 The Client retains its rights in Client-owned names, branding and original content, subject to the display licence granted in clause 4.
15.2 FAH retains ownership of the Find At Home platform, software, directory structure, templates, code, design system, taxonomy, search tools, branding, databases and other FAH intellectual property.
15.3 The Client may not copy, scrape, reverse engineer or commercially reuse FAH platform content or systems except to the extent permitted by law or written permission.
16. Liability and Fair Allocation of Risk
16.1 FAH will provide the Listing Service with reasonable care and skill.
16.2 To the extent permitted by law, FAH is not liable for indirect or consequential loss, lost profits, lost opportunities, third-party platform outages, search-engine changes, customer conduct, Client-supplied inaccuracies or events beyond FAH’s reasonable control.
16.3 Nothing in this Agreement excludes or limits liability or consumer rights that cannot lawfully be excluded under South African law.
16.4 The Client indemnifies FAH against third-party claims arising from material the Client supplied or instructed FAH to publish where the claim results from the Client lacking rights to that material or from unlawful or materially false Client-provided content, except to the extent caused by FAH’s own unlawful conduct.
17. General
17.1 This Agreement, the applicable invoice or quotation, the selected Listing Plan and any written variation form the agreement for the paid Listing Service.
17.2 If a provision is invalid or unenforceable, the remaining provisions continue to apply to the extent legally possible.
17.3 A failure to enforce a right immediately does not automatically waive that right.
17.4 This Agreement is governed by the laws of the Republic of South Africa.
17.5 The parties should first try in good faith to resolve a dispute directly. This does not prevent either party from using any court, regulator, consumer forum or other remedy available under applicable law.
18. Acceptance
By signing below, or by another recorded method of acceptance described in clause 1.3, the Client confirms that it has read and accepted this Listing Service Agreement and the applicable Listing Plan, invoice or quotation.
